Canadian Federal Immigration: Investment Immigration

Investor — Regulatory Requirements
To be an investor, the requirements are the following:

1. Managed and controlled a business for at least two years in the five years prior to submitting their application for immigration in Canada
2. Legally obtained a net worth of at least $800,000
3. Make an investment of $400,000 CDN with the Receiver General for Canada for five years and two months. The full amount of the investment (without interest) is repaid to the investor after approximately five years. The return of the investment is fully guaranteed by participating provinces and territories
4. Must have either:
- controlled a portion of the equity of a qualifying business
- been responsible for the management of the equivalaent of at least five full- time jobs per year in a business, for at least two years in the five years prior to submitting their application for immigration in Canada.

Management Experience
As an alternative to actual ownership, investors may qualify by providing documentary proof that he or she, over any two of the last years, has managed at least five full time employees in a business. Broadening the definition to include individuals who have exercised significant senior managerial control over businesses of a substantial size allows for the selection of senior management in a relatively larger organizations, notwithstanding that such managers may have not have an ownership interest or have assumed entrepreneurial risk directly.

The Quebec Immigrant Investor Program (QIIP):

Investors under the QIIP must:
1. have a net worth of at least CDN$800,00 acquired through lawful economic activities
2. have at least three years of management experience in a lawful and profitable
3. undertake to invest CAD$400,000 for five years by signing an agreement with a financial intermediary: a stock broker recognized by the Commission des valeurs mobilières du Québec or a trust company.

The Federal Entrepreneur Immigration Program

"Entrepreneur" means a foreign national who:
1. Has business experience
2. Has a legally obtained minimum net worth

"Business experience" means
In respect of an entrepreneur, the management of a qualifying business and the control of a percentage of equity of the qualifying business for at least two years in the period beginning five years before the date of application for a permanent resident visa and ending on the day a determination is made in respect of the application

"Net worth" means
In respect of an entrepreneur, means the fair market value of all of the assets of the entrepreneur and their spouse or common-law partner minus the fair market value of all of their liabilities

"Minimum net worth" mean
- in respect of an entrepreneur, CDN $300,000
- in respect of an entrepreneur selected by a province, the minimum net worth required by the laws of the province

"Qualifying Canadian business" means
- a business operated in Canada by an entrepreneur -- other than a business primarily for the purpose of deriving investment income, such as interest, dividends or capital gains -- for which there is in any year within the period of three years after the day the entrepreneur becomes a permanent resident documentary evidence of any two of the following:
 
  • the percentage of equity multiplied by the number of full time job equivalents is equal to or greater than two full-time job equivalents per year;
  •  
  • the percentage of equity multiplied by the total annual sales is equal to or greater than CDN $250,000;
  •  
  • the percentage of equity multiplied by the net income in the year is equal to or greater than CDN $25,000; and
  •  
  • the percentage of equity multiplied by the net assets at the end of the year is equal to or greater than CDN $125,000
  • "Full-time job equivalent" means
    1,950 hours of paid employment.

    "Net assets" means
    In respect of a qualifying business or a qualifying Canadian business, means the assets of the business, minus the liabilities of the business, plus shareholder loans made to the business by a foreign national and their spouse or common-law partner

    "Net income" means
    In respect of a qualifying business or a qualifying Canadian business, the after tax profit or loss of the business plus remuneration by the business to a foreign national and their spouse or common-law partner

    "Percentage of equity" means
    - in respect of a sole proprietorship, 100 per cent of the equity of the sole proprietorship controlled by a foreign national or their spouse or common-law partner
    - in respect of a corporation, the percentage of the issued and outstanding voting shares of the capital stock of the corporation controlled by a foreign national or their spouse or common-law partner
    - in respect of a partnership or joint venture, the percentage of the profit or loss of the partnership or joint venture to which a foreign national or their spouse or common-law partner is entitled.

    Self-employed Persons

    As a Self Employed person, relevant experience in cultural activities, athletics or farm management are a must. It is also a mandatory that you have the intention and ability to establish a business that will, at a minimum, create an employment opportunity for yourself. You must make a significant contribution to cultural activities or athletics or purchase and manage a farm in Canada.

    Conditions of permanent residence are not imposed on Self Employed persons. Please note that you must have enough money to support yourself and your family members after you arrive in Canada.

    Self Employed Persons -- Regulatory Requirements

    "Self Employed person" means
    A foreign national who has relevant experience and has the intention and ability to be Self Employed in Canada and to make a significant contribution to specified economic activities in Canada

    "Relevant experience" means
    In respect of a Self Employed person, at least two years of one of the following types of experience in the period beginning five years before the date of application for a permanent resident visa and ending on the day a determination is made in respect of the application, namely:
    * self-employment in cultural activities or in athletics
    * participation at a world-class level in cultural activities or athletics
    * farm management experience

    "Specified economic activities" means
    In respect of a Self Employed person means cultural activities, athletics or the purchase and management of a farm

    Canada Provincial Nominee Program : Prince Edward Island Provincial Nominee Program

    Immigrant Partner Criteria

    1. Immigrant partners are required to have a minimum net worth of $400,000.
    2. Immigrant partners must be prepared to make a $200,000 investment by way of preferred shares in an eligible Prince Edward Island company and to place $25,000 in escrow with the Government of Prince Edward Island, to be returned on evidence of one year's residency in Prince Edward Island.
    3. A combination of age, education, language skills and transferable management skills. The ideal candidate to the Prince Edward Island Provincial Nominee Program is/has:
    - Less than 55 years of age;
    - a minimum 14 years of education, including one (or more) post-secondary certificates or degrees;
    - capable of being interviewed in English or French;
    - has several years of management (or, preferably, business ownership) experience in a sector with relevance to the Prince Edward Island economy.
    4. Prince Edward Island will accept applicants who are not yet able to speak English or French - some of our finest applicants fall into this category - but, lack of skills in one of these languages must be offset by strengths in education or transferable management

    Canadian Federal Immigrant : Independent / Skilled Workers

    For Skilled Worker Class Immigration (Independent), the application is considered using scoring system out of 100. This scoring is based on applicant's background in: education, official language proficiency, employment experience, age, and adaptability.

    Canada Immigration: Family Class

    The definitions of close relatives or family members that can be sponsored by a Canadian citizens or permanent residents:

    1. Parents and grandparents
    2. Dependent children, including adopted children; children under 18 years of age whom you intend to adopt
    3. Brothers, sisters, nephews, nieces, or grandchildren who are orphans, under the age of 18 and not married or in a common-law relationship
